Reservation contract in MICE Portal

The reservation or booking contract is concluded electronically in the MICE Portal between the client and the service provider.

A legally binding booking or a legally binding reservation contract is concluded in the MICE Portal between the contracting parties customer and the hotel/event service provider if the hotel/event service provider has created an offer based on the customer’s request and the customer has accepted this offer in the MICE Portal by pressing the "book" button.

Please note: The contract is concluded exclusively between the customer and the hotel/ event service provider. The customer request is based on the GTC of the customer-specific MICE Portal. The contents of contract can be supplemented by comments in the comment field by both the provider and the customer. These become part oft the reservation contract upon conclusion of the contract, the customer’s GTC apply subordinate and supplementary. 

During the offer phase, both the customer and the hotel can also exchange file attachments via the communication button in the MICE Portal. However, file attachments are only part of the contract if they are explicitly referred to in the comment field of the contract. At the on-site event, the providers house rules always apply, so rules of conduct should not be regulated by accepting the hotel’s GTC in the reservation contract.

The aim is to agree on all services and prices as well as cancellation and payment conditions at the time of the booking in order to create clarity in the case of a contract change or even cancellation. After the end of the event, the services and prices agreed in the reservation contract apply as the basis for invoicing. 

Please note: Basis and prerequisite for the conclusion of the contract is the acceptance by the hotel/ event service provider of the terms and conditions of the MICE Portal. The acceptance of the terms of use / general terms and conditions of the MICE Portal is the so-called admission ticket to the bidding process of the customer. Agreements with the customer in the reservation contract that concern third parties and/ or the MICE Portal are void according to German contract law. This also applies to any commision restrictions, which are placed in the comments field of the reservation contract with the customer. 

 

1. Inquiry and quotation for an event 

To initiate a booking contract, the customer can submit a booking request via the MICE Portal. In response to the booking request, the service provider or supplier submits a binding offer and thus an optional reservation. This optional reservation is binding for the provider until the end oft he option period. A change of the option period📄 can only be adjusted after mutual agreement and must be made in the MICE Portal. 

Our tip: If there is a need for further communication or agreements, we recommend contacting each other via the message dispatch in the MICE Portal📄. This ensures correct and central documentation of all communication that can be acessed by both parties.

2. Conclusion of a booking contract 

By accepting the optional reservation, in the form of a binding reservation by the customer, the booking contract or reservation contract between the contracting parties is concluded electronically.

Upon successsful booking of an event, an e-mail is automatically sent to the service provider with a request for electronic confirmation. At the same time, with the acceptance of the offer by the customer, the reservation contract (PDF format) is automatically created and the contract is legally binding. 

Please note: The reservation contract is legally concluded when the customer has accepted the offer within the valid option period. A supplier who insists that a separate contract is still concluded with the supplier outside of the MICE Portal is acting against the terms of use in the MICE portal and may therefore be excluded as a contractual partner from the offer process of the MICE Portal in the future. 

The conclusion of a contract in the MICE Portal is subject to the identical regulations of the German Civil Code (§§ 145 ff.). The first required declaration of intent is the offer (also called application), which must be binding within the option period. This is followed by the declaration of intent to accept the offer, or declaration of consent or acceptance of the contract.
